Abstract: A View from the Bench - How to Appear Before Boards of Adjustment (Includes lessons learned on ensuring you know the requirements of the operative ordinance, preparing staff in anticipation of the hearing, carefully orchestrating hearing testimony and avoiding ex parte communications, among others.) ... Legislative and Case Law Update (Recent legislation and judicial decisions affecting land use, including a discussion of several bills that were considered by the legislature in the 2009 session, the act tolling development approvals and the legislation related to appeals of quasi-judicial decisions.) ... Driveway Permits and the Entitlements Process (The entitlements process is shaped greatly by the Buckland v. Town of Haw River rule that off-site improvements cannot be mandated as part of a site plan approval. However, obtaining site plan approval from the local government does not guarantee the ability to proceed. Increasingly, the NCDOT exercises great influence in the development process, because they control the driveway permits which include a number of off-site improvements. Since the parameters provided by Buckland are not applicable to driveway permits, there is not a clear line on what can and cannot be required by NCDOT in the driveway permitting process. Discussion of the current state of the law that applies to NCDOT in making their decision to issue or not issue a driveway permit.)
